WEBSITE & PORTAL TERMS

Terms of Use

These terms govern access to the BetterWebz public website and client portal. Paid services are also governed by the separate agreement accepted by each client.

Effective September 9, 2026

1. Acceptance of these terms

By accessing betterwebz.com, portal.betterwebz.com, or another BetterWebz-controlled page that links to these terms, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the website or portal.

2. Client service agreements control paid work

Website content describes BetterWebz services generally and is not, by itself, a binding offer or guarantee. Google Ads management, landing-page development, tracking, reporting, fees, timelines, ownership, and cancellation terms are governed by a separately accepted proposal, order, or service agreement. If that agreement conflicts with these Terms of Use, the service agreement controls for the paid services.

3. Accounts and authorized access

Client portal access is limited to people authorized for the assigned business. You agree to provide accurate information, protect your password and devices, and promptly notify BetterWebz of suspected unauthorized access. You may not access or attempt to access another client’s records, interfere with security controls, or share an account with an unauthorized person.

BetterWebz may suspend or terminate portal access when reasonably necessary to protect the service, comply with law, respond to misuse, or reflect the status of a client relationship.

4. Google Ads authorization and client responsibilities

If you authorize BetterWebz to access a Google Ads account, you represent that you have authority to grant that access. You remain responsible for the accuracy and legality of your business claims, offers, pricing, licenses, service areas, creative materials, website content, and other information supplied for advertising.

Google Ads accounts, advertising spend, policies, approvals, billing, and platform availability are controlled by Google. Unless a service agreement says otherwise, advertising spend is paid directly by the client and is separate from BetterWebz fees. Google access may be revoked through the Google account or the applicable Google Ads account controls.

5. No guarantee of advertising results

Advertising performance depends on factors outside BetterWebz’s control, including market demand, competition, budget, auction conditions, seasonality, client reputation, website and telephone response, pricing, and sales follow-up. BetterWebz does not guarantee a particular number of impressions, clicks, calls, leads, customers, jobs, revenue, rankings, or return on advertising spend.

Forecasts, examples, sample landing pages, testimonials labeled as samples, and illustrative portal information are demonstrations and are not promises of future performance.

6. Acceptable use

You may not use BetterWebz websites or services to violate law or third-party rights; submit malicious code; bypass access controls; scrape or copy protected portal information without authorization; impersonate another person or business; interfere with operation of the service; or promote deceptive, prohibited, or unlawful products, services, or claims.

7. Intellectual property

BetterWebz owns or licenses the website design, portal software, branding, text, templates, and other materials made available through its websites, except for client materials and third-party content. These materials may not be copied, resold, or used to create a competing product without written permission.

Ownership and permitted use of custom client deliverables are determined by the applicable client service agreement.

8. Third-party services and links

The website and services may rely on or link to third-party platforms such as Google, Supabase, Vercel, Stripe, hCaptcha, email providers, and call-tracking providers. Those services have their own terms, policies, availability, and security practices. BetterWebz is not responsible for third-party services outside its reasonable control.

9. Disclaimers

To the fullest extent permitted by law, the public website and portal are provided on an “as available” basis. BetterWebz does not warrant that every feature will always be uninterrupted, error-free, or compatible with every device or third-party service. Nothing on the website is legal, tax, accounting, or financial advice.

10. Limitation of liability

To the fullest extent permitted by law, BetterWebz will not be liable under these website terms for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from use of or inability to use the public website or portal. Any additional liability terms for paid services are stated in the applicable client service agreement.

Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

11. Changes and availability

BetterWebz may update website content, features, and these terms. The effective date identifies the latest version. Continued use after an update means you accept the revised terms. We may modify or discontinue website or portal features, subject to obligations in an active client agreement.

12. Applicable law

These terms are governed by applicable United States law. Any governing-law, venue, mediation, or arbitration provision in a signed client service agreement controls disputes related to paid services.
